Nursing Home/Assisted Living Facility (ALF) Abuse and Neglect

Our elders deserve dignity and safe care. We advocate for residents harmed by abuse, understaffing, or neglect, and hold facilities accountable for failing them.

Understanding your options

What should you know before making a claim?

Concerns about a resident’s safety deserve a timely response and a careful review of the care provided. Nursing homes and assisted living facilities operate under different Florida laws.

Start with the resident’s safety

If someone is in immediate danger, call 911. Suspected abuse, neglect, or exploitation can be reported to the Florida Abuse Hotline at 1-800-962-2873. Reporting a concern and seeking legal advice serve different purposes; neither should delay urgent medical attention or protection.

Nursing homes and assisted living are different

Florida law separately protects the rights of nursing-home residents and assisted-living residents. The facility’s license, responsibilities, and the resident’s care needs help determine which standards and procedures apply. A facility’s marketing name alone may not identify the governing rules.

Document concerns without jumping to conclusions

Record dates, observations, symptoms, and whom you notified. Falls, pressure injuries, dehydration, unexplained changes, or missed care may warrant investigation, but do not by themselves prove legal liability. Preserve care plans, medical records, photographs obtained lawfully, bills, and written communications. Keep observations factual and avoid sharing another resident’s private information.

Evaluating a potential claim

An investigation can examine the care required, what was actually provided, the people or entities responsible, and whether a failure caused harm. Staffing and facility records may be relevant. Nursing-home and assisted-living claims have specific pre-suit and limitations provisions, so seek advice promptly rather than assuming a general accident deadline applies.

Answers to common concerns

Questions about your circumstances

What should I do if my relative is unsafe now?

Call 911 for immediate danger or urgent medical needs. Suspected abuse or neglect may also be reported to the Florida Abuse Hotline. A civil claim is not a substitute for emergency protection.

Is every fall at a facility negligence?

No. The resident’s condition, care plan, supervision, precautions, and the cause of the fall must be reviewed. An injury alone does not establish a failure of care.

Can family members ask for a consultation?

Yes. A family member can explain concerns and ask what information is needed. Authority to obtain records or bring a claim depends on the resident’s circumstances and applicable legal arrangements.

Should I keep communications with the facility?

Yes. Preserve emails, letters, care-meeting notes, and dates of conversations. Keep original records and ask how to provide sensitive information securely.
